Two California-based musicians are suing the Grammy-winning songwriter Ed Sheeran for $20 million over his hit song “Photograph,” which the two claim bears a similar structure to their song Amazing that was recorded and released as a single by X Factor winner Matt Cardle in 2012.
The copyright lawsuit was filed by Martin Harrington, a songwriter and producer, and songwriter Thomas Leonard, in federal court in the Central District of California. The two songwriters and their publishing company claim that Ed Sheeran’s “Photograph” has the same musical composition from their track, “Amazing,” which the two wrote in 2009 and was released as a single by 2010 “X Factor” winner Matt Cardle.
According to PerizHilton.com, the lawsuit states that the two songs have the same musical compositions, particularly the chorus, which allegedly shares 39 identical notes in pitch, rhythmic duration and placement in the measure.
The lawsuit comes after the family of late soul singer Marvin Gaye successfully sued R&B recording artists Robin Thicke and Pharrell Williams for copyright infringement last year over their hit single “Blurred Lines,”.
Reports said that the English musicians are seeking a jury trial and damages in excess of $20 million, as well as royalties from the song which reports said has made an estimated profit of over $20 million.
In documents that include musical note comparison and chord breakdowns of the two songs, The two musician claim that Ed Sheeran’s “Photograph” shares 39 identical notes with “Amazing,” saying that the similarities between the two songs are “instantly recognizable to the ordinary observer.”
The 25-years-old Sheeran has become one of UK’s top-selling artists in the past two years and has also collaborated with artists such as One Direction, Taylor Swift and Justin Bieber.
The blockbuster hit “Photograph” was the fifth single from Sheeran’s breakout 2014 album “x”.
Harrington and Leonard’s song “Amazing” was adapted as a single by 2010 “X Factor” winner Matt Cardle, and the song “Amazing” has just made over 1 million hits on YouTube, while Sheeran’s music video for “Photograph” has gathered 208 million YouTube views.
